These terms govern your use of qstartlabs.com, operated by QStart Labs, LLC ("QStart Labs," "we," "us"). By using the site, you agree to them. If you do not agree, please do not use the site.
These terms are about the website, not about hired work. If we are building or running software for you, that relationship is governed by the master services agreement and statement of work you signed — not by this page. Where the two ever conflict, your signed agreement wins. See section 8.
1. Who may use this site
You may use this site if you can form a binding contract with us and are not barred from doing so under applicable law. If you use it on behalf of an organization, you represent that you are authorized to accept these terms for that organization.
2. What this site is
This site describes our services, our work, and our approach. It is provided for informational purposes. Nothing on it is an offer capable of acceptance, a guarantee of availability, or a commitment to take on a project. We become your vendor only when both parties sign a written agreement.
3. Acceptable use
You agree not to:
- Use the site unlawfully, or to violate anyone's rights.
- Attempt to gain unauthorized access to the site, our portal, our servers, or any related system — including probing, scanning, or testing for vulnerabilities without our express written permission.
- Interfere with the site's operation, or place unreasonable load on it.
- Scrape or harvest content at a scale that degrades service, or misrepresent our content as your own.
- Submit anything unlawful, misleading, or malicious through our forms.
We welcome good-faith security research, but contact us first at hello@qstartlabs.com so we can authorize the scope in writing. Unauthorized testing is not something we can treat as good faith, however it was intended.
4. Intellectual property
The content on this site — text, design, graphics, logos, case studies, and code — is owned by QStart Labs or our licensors and is protected by intellectual property law. The QStart Labs name and logo are our marks. Client names, logos, and trademarks that appear in our case studies belong to those clients and are used with permission to describe work we performed.
You may view, download, and print pages for your own internal evaluation of our services. Any other use — republication, redistribution, or commercial use — requires our written permission.
5. What you send us
Do not send confidential information through our contact form. It is a first-contact channel, and information submitted through it is not treated as confidential unless and until we have a signed confidentiality or services agreement in place. If you need to share something sensitive, tell us and we will arrange a secure method.
If you send us feedback, ideas, or suggestions about our business or this site, you agree we may use them without restriction, obligation, or compensation. This does not apply to information covered by a signed agreement between us.
6. Third-party links and services
This site links to third-party sites and uses third-party services — including Calendly for scheduling and Google for analytics. We do not control them and are not responsible for their content, practices, or availability. Their terms and privacy policies govern your use of them.
7. Published pricing and estimates
We publish price ranges because we think gating them wastes everyone's time. Those ranges are illustrative — they reflect what work of a given shape has typically cost, to help you judge whether a conversation is worth having.
They are not quotes, offers, or guarantees of price. Actual pricing depends on scope, complexity, timeline, and requirements, and is fixed only in a written proposal or statement of work signed by both parties. Similarly, results described in our case studies reflect specific engagements with specific clients; they are not a prediction or promise of what your project will achieve.
8. Relationship to client agreements
These terms govern the website. They do not modify, limit, or supersede any master services agreement, statement of work, non-disclosure agreement, or other contract between you and QStart Labs. If anything on this page conflicts with a signed agreement, the signed agreement controls entirely.
9. Disclaimers
The site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that its content is complete, current, or accurate.
Nothing on this site is legal, financial, security, or compliance advice. Our writing on regulatory frameworks is general information about how we approach engineering work, not advice about your obligations. Consult qualified professionals about your situation.
10. Limitation of liability
To the fullest extent permitted by law, QStart Labs and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of — or inability to use — this site. Our total liability for any claim relating to this site will not exceed one hundred US dollars ($100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. This section does not limit liability arising under a signed services agreement, which has its own negotiated terms.
11. Indemnification
You agree to indemnify and hold QStart Labs harmless from claims, damages, and costs (including reasonable legal fees) arising out of your misuse of the site or your violation of these terms or applicable law.
12. Governing law
These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. You agree that any dispute relating to this site will be brought exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction.
13. Changes
We may update these terms. When we do, we will change the "last updated" date above. Continuing to use the site after a change means you accept the revised terms.
14. Severability
If any provision of these terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the rest will remain in full force.
